After messing with my macOS Settings, and trying all sorts of permutations in Desktop and Dock, Displays and Control Centre, I have the Tools palette mouseover working, so I can now select other tools again. Yippee :)
It would seem that your software needs the Menu Bar Only "Automatically hide and show the menu bar" to be set to "Never" for the Tools palette mouseover to work.***
I did reset this when SharkCAD Pro was open and functionality was restored.
Other things to note, if in SharkCAD Pro the Untitled1 window is at the bottom just above the Dock, hitting the green maximise window sends it into the correct position under the top bar, so if in Settings you Save Palette and Dialog positions, then after quitting the application and re-opening the layouts and positions are as expected. This is repeatable, so if you switch this save position enablement off, the default behaviour on opening the application, is for the drawing window to always sit at the bottom of the screen with the title bar just above the dock.
For anyone else, I do have Stage Manager, Displays have Separate Spaces enabled, with my MateView monitor as the Main Display and the MacBook Pro as the Extended Display, otherwise SharkCAD top bar opens on the MacBook display.
Hope this is useful for other macOS folks using latest Sonoma build.

***Sorry this might be a red herring as I just set macOS's Automatically Hide the Menu Bar to Always and mouseover still works, but on opening you do see the SharkCAD drawing window at the bottom of the screen, before jumping up to its previous saved position.
